第1条（適用）

本規約は、末永　友成（以下「開発者」といいます）が提供するiOSアプリ「Framinoa」（以下「本アプリ」といいます）の利用条件を定めるものです。

本アプリを利用した時点で、本規約に同意したものとみなします。

第2条（本アプリの内容）

本アプリは、1日につき1つの写真や短い言葉を残し、時間の流れに沿って静かに振り返るためのiOSアプリです。

本アプリは、Day、Month、Yearの3つの表示を通じて、日々の記録を連続して眺めたり、月ごと・年ごとに振り返ったりする機能を提供します。

本アプリには、無料で利用できる機能と、Premiumとして提供される有料機能があります。

第3条（利用環境およびデータ保存）

本アプリは、iPhoneまたはiPadで利用できます。利用者は、自らの責任と費用で、本アプリの利用に必要な端末および利用環境を準備するものとします。

本アプリのデータは原則として利用者の端末内に保存されます。Premiumの利用者がiCloud同期を利用した場合、フレーム、写真、ハッシュタグおよび同期に必要な削除・更新情報が、AppleのCloudKitを通じて利用者のiCloudアカウントに紐づくPrivate Databaseへ保存され、同じiCloudアカウントを使用する対応端末間で同期されます。

iCloud同期には、iCloudへのサインイン、利用可能なiCloudストレージおよび通信環境が必要です。同期できない場合も端末内のデータは維持され、未送信の変更は次回の同期時に再試行されることがあります。

端末の故障や紛失などに備え、利用者は必要に応じて端末のバックアップ機能を利用するものとします。iCloud同期はデータの完全性または継続的な保存を保証するものではありません。

第4条（主な機能および記録）

本アプリでは、写真のみ、一言のみ、または写真と一言の組み合わせで、1日につき1つのフレームを保存できます。

一言は最大80文字まで入力できます。無料版の新規作成日は今日から7日前までで、Premiumでは未来を除く過去日を指定できます。編集時は記録日を変更できません。

写真、一言、ハッシュタグの編集、詳細画面からの削除、お気に入り登録、検索、ハッシュタグ・お気に入りによる絞り込みおよび写真があるフレームの画像書き出しを利用できます。

第5条（Premium機能）

Premiumでは、現行版において主に以下の機能を利用できます。

Premiumには、月額プランと買い切りプランがあります。日本の現行価格は月額300円（税込）または買い切り1,500円（税込）で、実際の販売価格はApp Storeの購入画面に表示される価格が適用されます。

月額プランはAppleのApp Store決済を通じた自動更新サブスクリプションです。契約期間終了前に解約しない場合、原則として1か月ごとに自動更新されます。

買い切りプランはAppleのApp Store決済を通じた非消耗型のアプリ内購入です。一度購入すると有効期限なくPremium機能を利用できます。ただし、返金や購入取消し等によりAppleが購入権利を無効にした場合を除きます。

  • フレーム・写真・ハッシュタグのiCloud同期
  • ハッシュタグの3件上限を解除
  • お気に入りと複数のハッシュタグを組み合わせたAND条件での絞り込み
  • 未来を除くすべての過去日へのフレーム追加
  • Frame Exportの週3枚上限を解除
  • 書き出し画像のFraminoaロゴを非表示にする設定

第6条（料金、更新、解約および返金）

Premiumの購入、更新、解約および返金については、AppleおよびApp Storeの規定が適用されます。

月額プランの解約は、本アプリを削除するだけでは完了しません。利用者自身でAppleのサブスクリプション管理画面から手続きを行う必要があります。解約後も現在の契約期間が終了するまではPremium機能を利用できる場合があります。

買い切りプランには自動更新および解約手続はありません。返金の可否はAppleの返金手続および規定に従います。

月額プラン終了後はiCloud同期を利用できなくなりますが、端末内の既存のフレーム、ハッシュタグおよび書き出し済み画像は削除・変更されません。同期済みのデータも、月額プランの終了のみを理由としてCloudKitから自動的に削除されません。無料版の上限を超えるタグはロックされ、日付、絞り込みおよびFrame Exportには無料版の制限が再び適用されます。

第7条（通知、写真および端末機能）

利用者は、設定画面から曜日と時刻を選び、記録リマインダーを有効にできます。初期設定は全曜日の21:00です。

通知の許可は、利用者がリマインダーを有効にした場合に限り要求されます。通知を拒否した場合や端末の設定を変更した場合、通知が表示されないことがあります。

写真ライブラリまたはカメラを利用する機能では、iOSの許可が必要になる場合があります。許可を拒否した場合、該当する機能を利用できないことがあります。

本アプリは、ライトモード・ダークモードおよびシステム設定・日本語・英語から選択できる表示言語に対応しています。

第8条（利用者の記録）

本アプリに保存された写真、一言、ハッシュタグ、日付、お気に入りその他の記録は、利用者が管理するデータです。

開発者は、これらの記録を広告、販売、公開、行動追跡、評価、要約またはAIによる処理の目的で利用しません。

利用者は、自身が保存または書き出す写真、文章その他の情報について必要な権利を有し、第三者の権利を侵害しないことを確認するものとします。

第9条（禁止事項）

利用者は、本アプリの利用にあたり、以下の行為をしてはなりません。

  • 法令または公序良俗に反する行為
  • 本アプリを不正な目的で使用する行為
  • わいせつな表現、露骨な性的表現その他の成人向けコンテンツを含む写真、文章その他の情報を、本アプリを利用して保存、作成、エクスポートまたは共有する行為
  • 児童の性的搾取または虐待に関するコンテンツを保存、作成、エクスポートまたは共有する行為
  • 第三者の権利や利益を侵害する写真、文章その他の情報を保存、作成、エクスポートまたは共有する行為
  • 本アプリの運営を妨害する行為
  • 本アプリの解析、改変、複製または不正利用を行う行為
  • その他、開発者が不適切と判断する行為

第10条（宗教・政治等との関係）

本アプリおよびその運営は、特定の宗教、宗教団体、政党、政治団体、政治運動その他これらに類する団体または活動による運営、支援、勧誘または宣伝を目的とするものではなく、これらとの提携その他の特別な関係を有するものではありません。

第11条（記録および免責）

開発者は、本アプリに保存される写真、一言、ハッシュタグ、日付、お気に入りその他の記録について、完全性、正確性および継続的な保存を保証しません。

端末の故障、紛失、アプリの削除、OSの更新、端末のバックアップ状況、通信障害、iCloudのサインイン状態・容量不足・仕様変更・障害、同期競合その他の事情により、記録が消失、重複、変更または一時的に利用できなくなる場合があります。

開発者は、本アプリがすべての端末やOSで正常に動作すること、または将来にわたり継続して提供されることを保証しません。

ただし、適用される法令により免責が認められない場合は、この限りではありません。

第12条（本アプリの変更・停止）

開発者は、利用者への事前の通知なく、本アプリの内容を変更、追加、停止または終了することがあります。

第13条（知的財産権）

本アプリに関するプログラム、画面デザイン、文章、ロゴその他の知的財産権は、開発者または正当な権利者に帰属します。

第14条（本規約の変更）

開発者は、必要に応じて本規約を変更することがあります。

変更後の利用規約は、本ページまたは本アプリ内に掲載した時点から効力を生じるものとします。

第15条（準拠法および管轄裁判所）

本規約は日本法に準拠します。

本アプリまたは本規約に関して紛争が生じた場合は、法令で別途定められる場合を除き、開発者の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。

Article 1 (Application)

These Terms of Use govern the use of the iOS application Framinoa (the “App”), provided by Yu-sei Suenaga (the “Developer”).

By using the App, you agree to these Terms.

Article 2 (About the App)

The App lets you save one photo, a short note, or both for each day and quietly look back over time.

The App provides Day, Month, and Year views for browsing daily records continuously and reviewing them by month or year.

The App includes free features and paid features offered as Premium.

Article 3 (Environment and Data Storage)

The App is available on iPhone and iPad. You are responsible for providing, at your own expense, the device and environment needed to use it.

App data is generally stored on your device. When a Premium user uses iCloud sync, frames, photos, hashtags, and deletion and update information needed for synchronization are stored through Apple CloudKit in the Private Database associated with the user’s iCloud account and synchronized across supported devices using the same iCloud account.

iCloud sync requires you to be signed in to iCloud and to have available iCloud storage and a network connection. If synchronization fails, on-device data is retained, and pending changes may be retried during a later synchronization.

You should use device backup features as appropriate in case of device failure or loss. iCloud sync does not guarantee the integrity or continuous preservation of data.

Article 4 (Main Features and Records)

You can save one frame per day containing a photo, a short note, or both.

Notes may contain up to 80 characters. The free version allows new frames dated from today through seven days ago. Premium allows any past date, but not a future date. A frame’s date cannot be changed while editing.

Features include editing photos, notes, and hashtags; deleting frames; favorites; search; filtering by hashtags and favorites; and exporting images from frames that contain photos.

Article 5 (Premium)

Premium currently includes the following main features.

Premium is offered as a monthly plan and a lifetime purchase. In Japan, the current prices are JPY 300 per month or JPY 1,500 for a lifetime purchase, including tax. The actual price shown on the App Store purchase screen applies and may vary by storefront.

The monthly plan is an auto-renewing subscription processed through Apple’s App Store. Unless canceled before the end of the current period, it generally renews each month.

The lifetime plan is a non-consumable in-app purchase processed through Apple’s App Store. It provides Premium without an expiration date unless Apple invalidates the entitlement due to a refund, cancellation of the purchase, or a similar event.

  • Synchronize frames, photos, and hashtags with iCloud
  • Remove the three-hashtag creation limit
  • Filter using favorites and multiple hashtags together with AND conditions
  • Add frames for any past date other than a future date
  • Remove the limit of three Frame Exports per week
  • Optionally hide the Framinoa logo from exported images

Article 6 (Charges, Renewal, Cancellation, and Refunds)

Apple’s and the App Store’s terms apply to Premium purchases, renewals, cancellations, and refunds.

Deleting the App does not cancel the monthly plan. You must cancel it through Apple’s subscription management screen. Premium may remain available until the current subscription period ends.

The lifetime plan does not renew and has no cancellation procedure. Refund eligibility is determined under Apple’s refund process and policies.

When a monthly plan ends, iCloud sync is no longer available, but existing on-device frames, hashtags, and previously exported images are not deleted or changed. Synced data is not automatically deleted from CloudKit solely because the monthly plan ended. Hashtags above the free limit become locked, and the free limits for dates, filters, and Frame Export apply again.

Article 7 (Notifications, Photos, and Device Features)

You can enable record reminders and select the days of the week and time in Settings. The default is 9:00 p.m. every day.

Notification permission is requested only when you enable reminders. Notifications may not appear if permission is denied or device settings are changed.

Photo library and camera features may require iOS permission. If permission is denied, the relevant feature may be unavailable.

The App supports light and dark modes and lets you select System Setting, Japanese, or English as its display language.

Article 8 (Your Records)

Photos, notes, hashtags, dates, favorites, and other records saved in the App are data managed by you.

The Developer does not use these records for advertising, sale, publication, behavior tracking, evaluation, summarization, or AI processing.

You are responsible for ensuring that you have the rights needed for photos, text, and other information that you save or export and that they do not infringe any third party’s rights.

Article 9 (Prohibited Conduct)

You must not engage in any of the following conduct when using the App.

  • Violating laws, regulations, or public order and morals
  • Using the App for an unlawful purpose
  • Using the App to save, create, export, or share photos, text, or other information containing obscene expressions, explicit sexual content, or other adult content
  • Saving, creating, exporting, or sharing content involving the sexual exploitation or abuse of children
  • Saving, creating, exporting, or sharing photos, text, or other information that infringes a third party’s rights or interests
  • Interfering with operation of the App
  • Unauthorized analysis, modification, copying, or misuse of the App
  • Any other conduct the Developer reasonably considers inappropriate

Article 10 (Relationship with Religious and Political Organizations)

Neither the App nor its operation is intended to be operated by, support, solicit participation in, or promote any particular religion, religious organization, political party, political organization, political movement, or any similar organization or activity. The App and its operation have no affiliation or other special relationship with any of them.

Article 11 (Records and Disclaimer)

The Developer does not guarantee the completeness, accuracy, or continuous preservation of photos, notes, hashtags, dates, favorites, or other records saved in the App.

Records may be lost, duplicated, changed, or temporarily unavailable due to device failure or loss, deletion of the App, OS updates, backup status, network failures, iCloud sign-in status, insufficient iCloud storage, changes or failures in iCloud, synchronization conflicts, or other circumstances.

The Developer does not guarantee that the App will operate correctly on every device or OS or remain available indefinitely.

This limitation does not apply where liability cannot be excluded under applicable law.

Article 12 (Changes and Suspension)

The Developer may change, add to, suspend, or discontinue the App without prior notice.

Article 13 (Intellectual Property)

Intellectual property rights in the App, including its software, interface design, text, and logo, belong to the Developer or the applicable rights holder.

Article 14 (Changes to These Terms)

The Developer may revise these Terms when necessary.

Revised Terms take effect when posted on this page or in the App.

Article 15 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan.

Unless otherwise required by law, the court with jurisdiction over the Developer’s location will have exclusive jurisdiction as the court of first instance for disputes relating to the App or these Terms.

본 앱은 Day, Month, Year의 세 가지 보기를 통해 매일의 기록을 이어서 살펴보고 월별·연별로 돌아볼 수 있는 기능을 제공합니다.

본 앱에는 무료로 이용할 수 있는 기능과 Premium으로 제공되는 유료 기능이 있습니다.

제3조 (이용 환경 및 데이터 저장)

본 앱은 iPhone 또는 iPad에서 이용할 수 있습니다. 사용자는 자신의 책임과 비용으로 본 앱 이용에 필요한 기기와 이용 환경을 준비해야 합니다.

본 앱의 데이터는 원칙적으로 사용자의 기기에 저장됩니다. Premium 사용자가 iCloud 동기화를 이용하면 프레임, 사진, 해시태그 및 동기화에 필요한 삭제·업데이트 정보가 Apple CloudKit을 통해 사용자의 iCloud 계정에 연결된 Private Database에 저장되고, 같은 iCloud 계정을 사용하는 지원 기기 사이에서 동기화됩니다.

iCloud 동기화에는 iCloud 로그인, 사용 가능한 iCloud 저장 공간 및 네트워크 환경이 필요합니다. 동기화에 실패해도 기기 내 데이터는 유지되며, 전송되지 않은 변경 사항은 다음 동기화 때 다시 시도될 수 있습니다.

기기 고장이나 분실에 대비하여 필요에 따라 기기의 백업 기능을 이용해야 합니다. iCloud 동기화는 데이터의 완전성이나 지속적인 보존을 보장하지 않습니다.

제4조 (주요 기능 및 기록)

본 앱에서는 사진만, 짧은 글만 또는 사진과 짧은 글을 함께 사용하여 하루에 하나의 프레임을 저장할 수 있습니다.

짧은 글은 최대 80자까지 입력할 수 있습니다. 무료 버전에서는 오늘부터 7일 전까지 새 프레임을 만들 수 있으며, Premium에서는 미래 날짜를 제외한 과거 날짜를 지정할 수 있습니다. 편집 중에는 기록 날짜를 변경할 수 없습니다.

사진·짧은 글·해시태그 편집, 상세 화면에서의 삭제, 즐겨찾기, 검색, 해시태그·즐겨찾기 필터링 및 사진이 있는 프레임의 이미지 내보내기를 이용할 수 있습니다.

제5조 (Premium 기능)

Premium에서는 현재 버전에서 주로 다음 기능을 이용할 수 있습니다.

Premium에는 월간 플랜과 평생 구매가 있습니다. 일본의 현재 가격은 월 300엔(세금 포함) 또는 평생 구매 1,500엔(세금 포함)이며, 실제 판매 가격은 App Store 구매 화면에 표시된 가격이 적용됩니다.

월간 플랜은 Apple App Store 결제를 통한 자동 갱신 구독입니다. 현재 이용 기간이 끝나기 전에 해지하지 않으면 원칙적으로 매월 자동 갱신됩니다.

평생 구매는 Apple App Store를 통한 비소모성 인앱 구매입니다. Apple이 환불이나 구매 취소 등으로 구매 권리를 무효화한 경우를 제외하고, 기간 제한 없이 Premium 기능을 이용할 수 있습니다.

  • 프레임·사진·해시태그의 iCloud 동기화
  • 해시태그 3개 제한 해제
  • 즐겨찾기와 여러 해시태그를 AND 조건으로 조합한 필터링
  • 미래를 제외한 모든 과거 날짜에 프레임 추가
  • Frame Export 주 3장 제한 해제
  • 내보낸 이미지에서 Framinoa 로고를 숨기는 설정

제6조 (요금, 갱신, 해지 및 환불)

Premium의 구매·갱신·해지·환불에는 Apple 및 App Store의 규정이 적용됩니다.

월간 플랜은 본 앱을 삭제하는 것만으로 해지되지 않습니다. 사용자가 직접 Apple의 구독 관리 화면에서 절차를 진행해야 합니다. 해지 후에도 현재 이용 기간이 끝날 때까지 Premium 기능을 이용할 수 있습니다.

평생 구매는 자동 갱신되지 않으며 해지 절차가 없습니다. 환불 가능 여부는 Apple의 환불 절차 및 정책에 따릅니다.

월간 플랜 종료 후에는 iCloud 동기화를 이용할 수 없지만, 기기에 저장된 기존 프레임·해시태그 및 내보낸 이미지는 삭제되거나 변경되지 않습니다. 동기화된 데이터도 월간 플랜 종료만을 이유로 CloudKit에서 자동 삭제되지 않습니다. 무료 한도를 초과한 태그는 잠기며 날짜·필터·Frame Export에는 무료 버전 제한이 다시 적용됩니다.

제7조 (알림, 사진 및 기기 기능)

사용자는 설정 화면에서 요일과 시간을 선택하여 기록 알림을 켤 수 있습니다. 기본 설정은 매일 오후 9시입니다.

알림 권한은 사용자가 리마인더를 켠 경우에만 요청됩니다. 권한을 거부하거나 기기 설정을 변경하면 알림이 표시되지 않을 수 있습니다.

사진 보관함 또는 카메라를 이용하는 기능에는 iOS 권한이 필요할 수 있습니다. 권한을 거부하면 해당 기능을 이용할 수 없을 수 있습니다.

본 앱은 라이트 모드·다크 모드와 시스템 설정·일본어·영어·한국어 중에서 선택할 수 있는 표시 언어를 지원합니다.

제8조 (사용자의 기록)

본 앱에 저장된 사진, 짧은 글, 해시태그, 날짜, 즐겨찾기 및 기타 기록은 사용자가 관리하는 데이터입니다.

개발자는 이러한 기록을 광고, 판매, 공개, 행동 추적, 평가, 요약 또는 AI 처리 목적으로 이용하지 않습니다.

사용자는 저장하거나 내보내는 사진·문장 및 기타 정보에 필요한 권리를 보유하고 제3자의 권리를 침해하지 않음을 확인해야 합니다.

제9조 (금지 행위)

사용자는 본 앱을 이용할 때 다음 행위를 해서는 안 됩니다.

  • 법령 또는 공서양속에 반하는 행위
  • 본 앱을 부정한 목적으로 이용하는 행위
  • 음란한 표현, 노골적인 성적 표현 및 기타 성인용 콘텐츠를 포함한 사진·문장 및 기타 정보를 본 앱으로 저장·작성·내보내기 또는 공유하는 행위
  • 아동의 성적 착취 또는 학대에 관한 콘텐츠를 저장·작성·내보내기 또는 공유하는 행위
  • 제3자의 권리나 이익을 침해하는 사진·문장 및 기타 정보를 저장·작성·내보내기 또는 공유하는 행위
  • 본 앱의 운영을 방해하는 행위
  • 본 앱을 분석·변경·복제하거나 부정하게 이용하는 행위
  • 그 밖에 개발자가 부적절하다고 판단하는 행위

제10조 (종교·정치 단체 등과의 관계)

본 앱과 그 운영은 특정 종교, 종교 단체, 정당, 정치 단체, 정치 운동 또는 이와 유사한 단체나 활동에 의해 운영·지원·가입 권유 또는 홍보되는 것을 목적으로 하지 않으며, 이들과 제휴나 그 밖의 특별한 관계를 맺고 있지 않습니다.

제11조 (기록 및 면책)

개발자는 본 앱에 저장되는 사진·짧은 글·해시태그·날짜·즐겨찾기 및 기타 기록의 완전성, 정확성 및 지속적인 보존을 보장하지 않습니다.

기기 고장·분실, 앱 삭제, OS 업데이트, 기기 백업 상태, 통신 장애, iCloud 로그인 상태·저장 공간 부족·사양 변경·장애, 동기화 충돌 및 기타 사정으로 인해 기록이 소실·중복·변경되거나 일시적으로 이용할 수 없게 될 수 있습니다.

개발자는 본 앱이 모든 기기나 OS에서 정상 작동하거나 앞으로도 계속 제공된다는 점을 보장하지 않습니다.

다만 적용 법령상 면책이 허용되지 않는 경우에는 그러하지 않습니다.

제12조 (본 앱의 변경·중지)

개발자는 사용자에게 사전 통지 없이 본 앱의 내용을 변경·추가·중지 또는 종료할 수 있습니다.

제13조 (지식재산권)

본 앱의 프로그램, 화면 디자인, 문장, 로고 및 기타 지식재산권은 개발자 또는 정당한 권리자에게 귀속됩니다.

제14조 (본 약관의 변경)

개발자는 필요한 경우 본 약관을 변경할 수 있습니다.

변경된 이용 약관은 본 페이지 또는 본 앱에 게시한 시점부터 효력이 발생합니다.

제15조 (준거법 및 관할 법원)

본 약관은 일본법을 준거법으로 합니다.

본 앱 또는 본 약관과 관련하여 분쟁이 발생한 경우, 법령에 별도 규정이 있는 경우를 제외하고 개발자의 소재지를 관할하는 법원을 제1심 전속 합의 관할 법원으로 합니다.
